Article 1 – Legal status of the contract
Depending on the establishment concerned, this rental contract is subject to the status of residences with services or tourist residences. This lease is entered into as a temporary residence, a short-term furnished rental. The premises may not be used as a principal or even secondary residence. The resident may not use the premises for any commercial, craft or professional activity. The occupying resident may not avail himself of the legal provisions applicable to residential leases, particularly with regard to the maintenance of the premises. Consequently, the contract will be governed by the provisions of the Civil Code and by the conditions set out herein.
Article 2 – Reservation
Reservation of a LORIENT RESIDENCE studio is only valid after acceptance of the customer’s reservation by the operating company. Confirmation of the customer’s reservation by the operating company remains at its sole discretion. In addition, to be binding, the reservation must be guaranteed by a valid credit card issued by a reputable institute, or have been the subject of a prior credit agreement with the operating company, or be followed by payment of a deposit or full payment for the stay.
Payment must be made within 5 days of booking. After this time, the booking will be cancelled. If the booking is cancelled, the deposit may be retained in accordance with the conditions specified in article 7. Group bookings, i.e. bookings for more than 8 flats reserved by the same entity for the same period, are subject to specific group conditions.
Different conditions may apply to special offers. In this case, the special conditions mentioned under the price description on the booking page or on the relevant communication medium take precedence over the conditions mentioned above.
Article 3 – Terms of payment
Invoices must be paid immediately on presentation. On the day of the customer’s arrival, the operating company will invoice the customer for the entire stay, with the exception of stays of more than 28 nights, for which invoices will be issued and presented monthly and payable in advance. If it has been agreed that payment for a resident’s stay will be made by a third party, the resident -occupier- will remain jointly and severally liable for the payment in question. Payment for all optional services will be required on presentation of the corresponding invoice. The credit limit accepted by the operating company for this type of service is 200 euros. The operating company will be entitled to 1.5% interest per month on any sum not paid by the due date. In the event of a balance remaining unpaid on the resident’s departure date, the operating company reserves the right to debit his or her credit card for the amount outstanding.
Article 4 – Price
Prices are given in euros. They include electricity and water charges (within the limits of reasonable and responsible consumption) and Internet subscription. They only include the temporary use of the furnished flat. Optional services will be subject to an additional charge.
Article 5 – Changes to length of stay
The length of stay is that specified in the booking confirmation or accommodation offer. Subject to availability and at the discretion of the operating company, the length of stay may be extended, without any obligation to remain in the same flat or at the same price. If an extension of stay is accepted and a new price is applied, the new price will be applicable from the first effective day of the extension.
In the event of early departure, the applicable price will be that corresponding to the shortened stay and will apply from the date of arrival. For an initial stay of less than 28 nights, the resident is requested to inform the residence of the new departure date at least 48 hours in advance. Failure to do so may result in the payment of a departure fee of between 1 and 2 nights, depending on the operating criteria. For an initial stay of more than 28 nights, the resident is requested to inform the residence at least 15 days before the new desired departure date. Failure to do so may result in the payment of a departure indemnity ranging from 2 to 7 nights depending on operating criteria.
Article 6 – Cancellation / No-show
All cancellations must be notified to the operating company in writing. The effective date of a written cancellation will be the date on which it is received. In the event of cancellation, compensation must be paid to the operating company in accordance with the criteria set out below:
– If your stay is between 3 and 27 nights: any cancellation received less than 48 hours before the scheduled arrival date will be subject to a cancellation fee equal to 2 nights’ stay, i.e. €138.00.
– If your stay is 28 nights or more: any cancellation received less than 72 hours before the scheduled arrival date will be subject to a cancellation fee equal to 4 nights’ stay, i.e. €220.
Failure to arrive (of the reservation) in the absence of a cancellation will be deemed to be a ‘no-show’ and will be subject to the compensation specified above.
Certain exceptional or special rates may be ‘non-refundable’ regardless of the date of cancellation. In this case, the cancellation conditions detailed above do not apply and the total amount prepaid cannot be refunded for any reason whatsoever.
Article 7 – Arrival & Departure
Keys are handed over from 3pm on the day of arrival. They must be returned before 10am on the day of departure. As our establishments have different opening days and times, it is the resident’s responsibility to check these when booking and, if necessary, to inform the establishment of an arrival or departure outside the opening times. The residence will then make arrangements directly with the resident to provide him/her with the necessary access codes and the procedure to follow.
Article 8 – Obligations of the resident
The studio will be made available to the resident in a good state of repair. The resident will use the rented premises and their facilities as a ‘good father of the family’. They must comply with the maximum occupancy standards per rented flat indicated on the price lists for each type of flat and residence. An inventory is kept in each flat. The resident must check the accuracy and quality of the inventory on arrival and report any anomalies, missing or damaged items to reception within 24 hours of arrival. On the resident’s departure, the inventory and state of cleanliness of the flat will be checked by the operating company and the resident will be billed for any missing items or damage caused to the flat. The operating company reserves the right to enter the rented premises for maintenance or security purposes.
Article 9 – Responsability
The operating company may not be held liable in the event of theft or damage to personal belongings in the flats, communal areas, car parks or any other outbuildings or annexes of the residence: as this accommodation contract is subject to the status of serviced or tourist residences, the provisions of articles 1952 et seq. of the Civil Code, relating to hoteliers, do not apply.
Article 10 – Aftersales
The on-site teams are on hand during your stay to respond to any complaints, resolve any malfunctions observed and ensure that you enjoy your stay to the full. Any complaint may be sent by registered letter with acknowledgement of receipt to SARL BEQUIA – LORIENT RESIDENCE – 758 rue Pierre Landais – Pôle d’activité de Kerpont – 56850 Caudan – France.
Article 11 – Changes to services
If circumstances so require, and only in the event of force majeure beyond its control, the operating company may be obliged to modify all or part of its services, both accommodation and additional services. Services not provided will not be invoiced, but no compensation may be claimed.
Article 12 – Termination – Penalty – Non-renewal
The contract will be terminated ipso jure, without formality and without delay, in the event of non-performance by the resident of any of his/her obligations or inappropriate behaviour likely to disturb the stay of the other occupants.
The resident must leave the premises immediately and may be evicted if necessary with the assistance of the police.
